Legal Question in Business Law in New Jersey

Hello,

I am in the process of opening a beach equipment rental stand in NJ . I am trying to find information regarding payments. Im i allowed to ask for a license and once payments are met at the end of the beach day they will receive there license back.

I am afraid that people will rent equipment and not come back to pay.

You can do that, but you take responsibility for it. So if, for example, you misplace, lose or otherwise destroy it even by mistake you would be responsible for any out of pocket loss they incur to replace it. That might mean lost wages, any fees, maybe transportation costs if for example they drove to where you are and are unable to drive back home because driving without proof of license is a violation, etc.

You know, a lot of rental places like you describe end up being operated by bone-headed teens so you just have to make sure you are not setting yourself up for a problem. Why not just copy the license and keep cc info on file just like a car rental place will do?

You are going to have a number of legal considerations beyond this as well so it might be helpful to discuss your objectives over with a lawyer in private.
