Legal Question in Civil Rights Law in New Jersey

In NJ the Attorney General has guidelines in which random drug testing of police officers can be performed. If these guidelines are not followed properly would it be illegal to take urine from a Police Officer? If urine was taken and the Officer did not know at the time that the guidelines were not followed at all, could the urine have been thrown out due to violating the officers 4th amendment right against unlawful search and sizesure?

If it only effected his emploement status the answer is no. If criminal charges stem from it, there are many arguement to be made.
