Legal Question in Civil Rights Law in New Jersey

how do I protect my reputation?

I need to know what I can do about somebody that makes false claims to the police and had me arrested for terroristic threats. I already have the evidence I need to beat the charge. What can I counter charge this person with?

Re: how do I protect my reputation?

Based on your very limited post, you MAY have a claim for malicious prosecution. This is not a "counter" charge.

You wrote: "I already have the evidence I need to beat the charge. " Therefore I am assuming that you have not gone to court yet. Even if you feel you have clear evidence of your innocence, you should have an attorney represent you on the criminal charge. Often, folks who try to represent themselves do not get their evidence into the record due to their unfamiliarity with the rules of evidence and procedure.

Assuming you are acquitted, AND you have evidence that the alleged victim knew the complaint was false at the time it was made, you could pursue a civil complaint for malicious prosecution.

Best of Luck. Feel free to call my office if you need any further assistance.
