Assault by elderly

I have been harassed by my neighber who is 85 year old man. He has come at my children with a knife and a shovel. This is all on record with the police. Today, my husband was outside who is a lot younger and bigger,and was talking to people working on our house. The man came out with an ax handle help up in the air and shoved my husband because my dog ran on his front lawn, my husband was on sidewalk. My husband just walked away. I am pressing charges because I don't want my children to get hit by this man and he has no right to hit anybody, even if he is 85 years old. I am planning on filing a charge against him. I don't know if the court will take his side because he is an elder and he will get away with this. Constantly cursing at my sons and harassing us. Now it has gotten out of hand.

You should notify the police and ask them to press charges against your neighbor. If they won't, then you have the right to file a Citizen's Complaint against him. I honestly don't think that the court will side with him because of his age. In fact, the court would be more likely to side against him if he has been threatening harm to your children. You should contact the police today to either charge him themselves or to let you charge him under a citizen's complaint. Good luck.

Old people can do wrong, too. It is just matter of getting the names and addresses of any witnesses and having them subpeonaed for the trial.
