Legal Question in Criminal Law in New Jersey

Hello, My cousin was charged with gambling under the age of 21 in Atlantic City, NJ. He live in Bayonne, NJ and it was his first time to go to Atlantic city and he didn't know the rules. He's 19 years old and he used to gamble in Staten Island in New york. because it's the nearest Casino to him and the casinos there are +18. He's is now charged to pay a fine in the court. It's okay for him to pay the fine but the only bad thing is that he's an asylum. he doesn't have a green card or social security and he's making a case to get them and stay in the USA. so does that issue affect his case? and will that be in his record?
