Legal Question in Criminal Law in New Jersey

NJ Expungements

in 2002, I had a fourth degree crime of aggravated assult with weapon 2C:12-1b(4) which I was forced to plead guilty to and I was told that I may get it expunged because it is a 4th degree crime (disregarding everything else). My other option is to have this case reopened because at the time money was an issue. The Elizabeth detectives had no case until I surrended my weapon so the ''victim'' can identify it. The victim wasn't given a line up of weapons, he was shown my weapon which I legally owned since the age of 21. I have remained quiet about this situation and when I attempted to speak up the Union County Prosecutor threatened me with 18 months in jail and my attorney finished burying me. The ''victims'' in this case were looking for a payout. They really held on to a job, DYFS had investigated them for child abuse; in other words they were of poor moral character. I, on the other hand, have owned homes, worked all my life and never been arrested or in any kind of trouble. Can an attorney with guts answer this question?

Re: NJ Expungements

You have to wait 10 years for an expungement, so your best bet is a PCR application. However, time is seriously running out as you only have 5 years, thus now is the time to act! My office is in New Brunswick, so I'm probably not to far from you. I'd like to meet with you ASAP, my intial consultations are always free.
