No. Prosecutors in NJ are forbidden by judicial order from dealing on first time DUI cases. Their hands are tied.

Plea bargaining in dwi cases in barred by court rule in New Jersey, but it is possible to develop

a factual basis for reducing the severity of the sentence on a dwi. Of course, you could have a defense. For example, if you were tested on the old breathalyzer 900 machinge it might be possible to

suppress the use of the reading, due to some defective in the certification of the ampoule used in the test, due to the use of a Canadian company for this purpose as the use of the Breathalyzer 900 is fazed out in favor of the Alcotest 7120 breath test machine. Additionally, there is the possiblilty that the reading on a Alcotest 7110 might be reduced by a margin of error which can be calculated from the digital readout of the machine.
