do old statues count

1972=impaired driving / 6 month

1993=dui / 6 month loss of lic.

2006=dui / postponed

1972 violation was different statue. does it count making total 3? Thank you.

If in 1972 your out of state violation was for a breathalyzer reading was for a violation which would not be a violation in new jersey. For example, if in 1972 a violation in New Jersey

required a .10 and your violation was for less than a .10 it might not be counted.

To be truthful with you, although I was an attorney in New Jersey in 1972 I do not remember the requirements of dwi law in existence at that time. Over the years the law has been revised several times.

It would be necessary to obtain certified informanation from the court in which you 1972 offense was handled and then research the dwi

law of 1972 to appropriately answer your question.

If the 1972 offense is one that would count in New Jersey you would be facing a ten year loss of license and at least 90 days in jail, if you spent the other 90 days in an inpatient alcohol rehabilitation program.

I would have to do some research, but from what I can remember, the ID charge in 1972 was the same as DWI. If that is the case, you are looking at a mandatory 90 days in jail. Also, there are no plea bargains with DWI anymore. You need to have a good attorney that can get the right expert on your side and throw everything at the case.
