Legal Question in Family Law in New Jersey

my dad is divorcing his wife, she stole money out of their joint account. She never contributed any monies. Can he take her to court and win, it clearly was premeditated with an aim to defraud. My dad is 85 years old and his soon to be ex is 55.

On a joint account, without restrictions such as requiring that both parties sign, either party can withdraw the funds. He should move the balance to an account in his name alone.
