Legal Question in Family Law in New Jersey

Divorce-Relocation Inquiry

I reside in the state of NJ. I have filed a petition for divorce on the basis of infidelity. We share two children. I have filed for joint custody, however I have requested of course residential custody. When this divorce is final, what are my restrictions in regards to relocating to another state with my children?

Re: Divorce-Relocation Inquiry

The answer lies in whether you can convince the Court that your desire to relocate is reasonably related to earning income or otherwise obtaining financial and other forms of support from from your family which resides in the State where you intend to relocate, instead of the purpose of depriving your spouse of visitation with the children.

Do you have an attorney for the divorce? I suggest you get one. If you handle the case the right way, you should be able to just make the removal issue part of the divorce so its all ready to go.
