Legal Question in Family Law in New Jersey

My fiance and had a baby in February. she lives in NY and i in NJ. i no longer feel my son is in a healthy environment

my fiance solely depends on her mother to provide. i own a business and have my own apartment. i have provided 95% of our sons necessities i even provided for her mothers household. the issue is just recent they were with utilities for 3 days and she neglected to tell me our son is in this situation. since my fiance was young. she and her siblings have been subject to living in shelters, hotels and varies different apartments due to their mothers inability to keep a roof over there heads purposely from not paying rent.

they currently live in a rat infested place where i killed 6 rats in one night. i reached out to some people got them an apartment here in NJ near me. now all of a sudden her mother does not want the apartment and they are subjected to losing the apartment they are currently in. i no longer feel my newborn son is in suitable environment in their care. my fiance wont move in with me because the resources she is getting being a mother goes to her moms household. were do i stand to obtain custody. at least until my fiance is ready to move in with me

Fiance, by definition, means you intend to marry. So the main question that needs to be answered is why haven't you gotten married and moved into your own home together with your child? I also question in what way your fiance "solely depends on her mother" when her mother is not providing any shelter for her. It appears to me that the best way to deal with this is for you to get a place for the three of you to live in and you can then provide for your fiance and child. Even better, since she is your fiance, just marry her. I would think that she would not object to moving from her mom and in with her husband. If she does, you have more problems than you think you do and a true re-evaluation of your situation needs to be completed.
