Legal Question in Immigration Law in New Jersey

husbands green card

my husband has been in america since 1978 he and his mother did the application to get his green card in 1979, his brother recieved his, his mother became a citizen here, but he never received anything.he has been divorced once nad remarried, he has a total of 4 kids here. he has a social security number but never receive his green card.he wants to know how does he find out if he has one or not. please inform me of how we can go about figuring this out. thank you.

He can file a Freedom of Information Act request. If it comes back that he isn't a lawful permanent resident, if you are a U.S. Citizen can file for him. Or, if he has a child over 21 who is a U.S. citizen, the child can file for him.

2) Where does he live now?

3) Does he have an attorney representing him?

4) Has his lawyer been down to the local immigration office, to check on his case?

In order to determine if there is/was a previous file with the CIS he can file a Freedom of Information Act request. If it turns out that he is not a lawful permanent resident then it may be possible for the U.S. Citizen relative to file for him. In the alternative, if he has a child over 21 who is a U.S. Citizen, then the child may be able to file for him to receive a green card.
