Hi Lawguru

I got a restraining order for my husband. I am on a H4 right now.He has his EAD and H1.Can he switch to EAD while the divorce is still pending... does this affect my status??

Please let me know.

Yes, he can. Yes, it will affect your status. More importantly, if you are divorced and your husband is the primary beneficiary of an employment-based green card petition, you will no longer qualify for a green card as his dependent.
