Legal Question in Landlord & Tenant Law in New Jersey

I lived in NJ in the same apartment for 10 years. My father was a cosigner on the initial 2 year lease. When that lease expired we were never asked to sign another lease for the additional 8 years. Is my father still liable legally for that apartment?

The textbook answer is "yes". If you were not offered a new lease, you and your father are holdover tenants and the terms of the tenancy remain the same except that it is month-to-month. That said, I would not be surprised if there were not something that occurred during the past ten years that might change that. If the issue is important to you, I recommend that you consult with a lawyer in your area to discuss the matter.
