Legal Question in Landlord & Tenant Law in New Jersey

we are renting a house and our landlord is trying to evict us because we are late (2 months)but we just found out the house is not registered to be a rental property,and the judge said if we bring 2000 dollar deposit he will hear our case.is this legal?and can we sue our landlord because the house is not listed with the township as a rental?
