Legal Question in Real Estate Law in New Jersey

My brother recently finished a lawsuit with someone who sold him machines about payments. The result of the lawsuit was that my brother needed to return the machines to the person who sold it to him. Now my brother is being sued again by the same person for more than the machines worth for excessive damages, even though the machines were inspected and OK'd before delivery. Is this a valid charge against him?

There is a good possibility that the second suit is foreclosed because of a court rule that says that all similar causes of action have to be joined in the same suit. If you ask your brother to call, I will be able to help him.
