Legal Question in Real Estate Law in New Jersey

Lease Breakage

Hi,

I lived in an apartment community for more than 2 years. After my 2 year completion, i had to move to a new place because of personal reasons. I paid lease breakage fee and two month rent( notice period ). The landlord still asked me to pay till they rerent the apartment. And I also requested them the keys to sub-rent the apt., if they are not able to rerent it. But they said that is not their policy.

Please help to resolve this issue.

Re: Lease Breakage

Please be advised that I have not been retained to represent you and I am basing this response on the limited amount of information supplied. However, what does your lease agreement say? I would have to see the agreement in order to properly advise you. How long was the term of the lease? You stated that you completed two years, then you paid two months "Notice" and a lease breakage fee. You then offered to sub-let. It seems as though you have made efforts to mitigate damages and pay your debt. How long has it been and what efforts has your landlord made to rent the apartment. You may have a landlord tenenat claim, but as stated, I would need more specific information in order to properly advise. If you wish to discuss this further, feel free to contact me at 908-537-7975.

Good Luck!
