Legal Question in Traffic Law in New Jersey

NJ provisional license speeding ticket

Just recently I was given 2 tickets on Loantaka Way in Madison, NJ. One ticket was for careless driving and the other ticket was a speeding ticket where I was going 73 on a 40. I was late to work that day hence forth the speeding there was also barely any traffic on both sides of the street, and it was the middle of the day, but I was unable to see the police car who I believe got my speed on a radar gun. I'm 17 turning 18 before my court date and I have no prior points on my license. The police officer also said that due to some repairs being done to the court house I will have to go to court in the Florham Park Municipal Building. I have a few questions that I wish to be answered and your help will be much appreciated. First would getting a lawyer aid my chances in lowering the repercussions that I will be facing aside from me representing myself? How much should I expect the fines would be? How many points will I be looking at and how many points can I get taken away in a plea bargain? Will I get my license suspended? Lastly what is the estimated fee for a lawyer? Thank you.

Driving 33 mph over the speed limit can be the basis for a judge to suspend your driving privileges for several months. You need to hire an attorney to save your driver's license.

I agree with Mr. Moore, you DL is at risk here with the speed. Because of your PDL, you are going to get some points but I'm sure a good lawyer can work it out so you don't really feel the impact of the points. How much a lawyer will be depends on a variety of factors but I don't suggest you base it solely on price. After all, you get what you pay for.

Re: NJ provisional license speeding ticket

Dude, u r screwed! 74 in a 40? At least 1/2 the judges will take your license for a while for that alone. That shows poor judgment. (I will not discuss riding my motorcycle on the roads at night, with a 'modified' plate, and make reading my plate at night impossible, before I could get a license) Do NOT go to court w/o an attorney! An attorney can not assure you of any outcome, but, attorneys spend YEARS learning how to soften the blow, read people, call around to find out how the judge and prosecutor are, put the best spin on something, etc. Things you need done, that you just are not going to be able to do. You need someone to talk to you, and then deal with the prosecutor, the policeman, and judge. I could spend hours talking about the variables, but I can't here, and results vary, but there is a 90% chance you will benefit from hiring an attorney. Example - I had a guy, 21, never had a ticket, on the Parkway, in his new WRX, and a guy in a Mustang GT taunted him, and he "raced" the guy... Cop saw them, the WRX pulled over, the Mustang took off, the cop got on the speaker, and told the WRX to follow him. He did. He could have received 14 points in tickets, but received 11. I got the cop down to 2 points. (I was thrilled, so was the client) An attorney can try things you can not. An attorney knows the law, you do not. An attorney knows what NOT to say, you do not. Prosecuting is BORING, and personally, if I can get the prosecutor or cop to laugh good, I can usually get good results. YOU will not get the prosecutor or cop to laugh, YOU have to be humble, admit you screwed up, because you are an idiot (whether you believe it or not). You are looking at a range of fixed fees, $400-800, most charge in the middle, $600. Don't be a bone head (again), GET AN ATTORNEY!
