Legal Question in Traffic Law in New Jersey

I was riding in my car with a friend we got out went to the bar. I got out and began to walk to the bar when police stopped and turned around. They stopped me in the street to ask me if it was my car parked. I tell them yes and they proceed to give me driving while suspended tickets & suspended registration. I was never behind the wheel of the car. So how are they able to charge me with that?

They are able to charge you with anything that they have a reasonable suspicion that you violated. It is then up to the prosecutor, with appropriate evidence, to prove the charge beyond a reasonable doubt. You are presumed innocent unless and until proven guilty beyond a reasonable doubt. Note that even if your friend was driving the car, the suspended registration ticket may be established against you for allowing your friend to drive your car with the suspended registration (if that is indeed the case). You should seek the advice of an attorney experienced in the practice of municipal court law.

Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. You will only be able to rely on advice from an attorney who you have actually retained. Good luck! Rob Gleaner
