Legal Question in Workers Comp in New Jersey

Entitlement to a second opinion

I was injured while at work. As a result of that injury I have been out of work and receiving Workers Compensation Benefits and under the care of a physician who prescribed medication and physical therapy. After 3 1/2 weeks I am still experiencing pain. I asked my employer if I could see another physician for a second opinion and am getting the run around. I would like to know if I am entitled to a second opinion under NJ Workers Compensation Law. I am willing to see an ''In Network'' physician and have told my employers that but they are still balking. The physician I was sent is on staff at the hospital I work (if that means anything). Any information you could provide would be greatly appreciated.

Re: Entitlement to a second opinion

you will need to go to court and get a judge to order the change. If you can show that you are not being treated properly, you will win. You should think about seeing another doc for a second oinion on your own.
