Legal Question in Consumer Law in New Mexico

my mother is claiming that she has the she can take my vehicle from me....but both hers and mine name is on the registration and title which is still with the loan office. Can she take the vehicle away from me? I have had the vehicle in my possesion for 4 years and paid 9000 towards it....a check does show where 8000 is my monies toward the purchase. This evening she also threated me that she would kick my ass as well as discriminated against my sexual orientation.

You did not tell the guru how old you are. When you are asking questions about what your mother can and cannot do how old you are is central to the answer. Next, it sounds like you have a business arrangement with your mother. If I had to guess, since you didn't say, I suspect she co-signed on the loan for your car. If she did that means that she is responsible for the loan if you quit paying. She may very well feel the threat of a financial burden if you move out of her house because while you may be paying the car loan right now if you have to start paying rent and the car loan you might begin to miss payments and then the bank (or loan company) will be coming after her. You did not present any of this information so I am only guessing what might be on her mind when she makes such statements as you described. Last, discrimination by a household member against another household member because of sexual orientation may not be a legal issue. You fail to describe clearly what is the discrimination.

There are family mediation people in your town and rather than a lawyer you may want to consider going with your mother to a mediator to resolve these issues. You and your mother will have a lot more years together to address lots of different issues in each of your lives. Learning NOW how to address family communication issues might serve you better than seeking a legal resolution to your present family issues.
