Legal Question in Criminal Law in New Mexico

my grandfather gave me to atvs for my daughters .He latter passed away and my grandmother had a stroke or dimentia were not sure but she is charging me and my wife with theft and we were arrested and bailed out my lawyer is trying to help but the court is still taking her testimony even though she has been found physically unable to care for herself we are not sure what to due as we are looking at 4.5 years in prison and 15k in fines each .Neither one of us have ever been arrested and are in our late 30s
