A Convicts Chances

How (what) can a convicted felon, mother, fight and win a custody battle with the aunt of her children ( NM kinship guardianship act)?

The first part of the question needs determination made as to (a) whether the convicted felon is in prison or not; next, (b) since guardianship act is mentioned the question arises as to whether a guardianship was created for the aunt? After those questions are answered then a course of action can be determined. If a guardianship exists then certain things will have to be done; if the felon is in prison then other questions will arise.

Please provide additional information and a more direct answer will be forthcoming.
