Legal Question in Family Law in New Mexico

My parents are legally divorced. My car is fully in my dad's name. Although he is incarcerated, is my mom allowed to take my car? I'm 16, almost 17.

Parents have a lot of lee-way about how to raise their children. If you file a law-suit to seek an injunction against your mothers' actions you may find even before you are given the chance to explain to a judge how it is that your mother is wrong, that you have to convince the judge you can conduct the lawsuit without having a Guardian ad Litem assigned to you. Understand that the judge may refuse to allow you to conduct a lawsuit on your own because you are not legally responsible. Your mother is the adult who is responsible for you. She may tell the judge she cannot afford to hire a lawyer for you just so you can ask the judge to order her to raise you in a particular manner or style. . . . . such as letting you drive a car in which you cannot demonstrate any ownership interest. Most judges would call that a responsible adult.
