Legal Question in Family Law in New Mexico

My sisters boyfriend has taken their son who is now 2. He has not brought him back yet. Is there anyway for her to get him back? Also, what can she do so that will not happen again?

If she does not have parenting plan approved by a court, she needs to get the process started by filing a paternity suit. This establishes the paternity of the child and sets the stage for the court to approve a parenting agreement that establishes custody arrangements and child support. In principle she could file a charge of custodial interference but if there is no custody document then that won't go far.
