if a second action is deemed a part of the first, and a new suit is filed, what are the legal consequence's?

If the first has been adjudicated, the second is subject to dismissal under the doctrine of res adjudicata. If the first has not been adjudicated, then the second should be incorporated into the first by Motion for Joinder.
