I have a criminal record. Can I get a type 1 or 5 visa? Last offense 2 years ago. Brazilian visa

It is important for You to consult with an immigration lawyer who can examine all of the facts of your criminal record and advise whether that criminal record makes you inadmissible and/or deportable. The attorney will also advise You on the consequences of being inadmissible or deportable.

It is my understanding that you asking about E1 and E5 type of status. E1 is only available to nationals/citizens of treaty countries. If you are a national/citizen of Brazil, then E1 is not available to you. You can go to http://travel.state.gov/visa/fees/fees_3726.html to look for treaty countries.

E5 (also known as EB5) may be available to you. To qualify as an Immigrant Investor, a foreign citizen�must invest between U.S. $500,000 and $1,000,000, depending on the unemployment rate in the geographical area, in a commercial enterprise in the United States which creates at least 10 new full-time jobs for U.S. citizens, permanent residents, or other lawful immigrants, not including the investor and his or her family. The foreign citizen will have to show that the investment money was obtained by lawful means. Since E5 application process is very complex, You should consult an experienced immigration attorney before making any decisions.
