Legal Question in Business Law in New York

I don't need a definitive answer or a long explanation. I would just like a best guess, when it comes to if you think my idea would be considered legal or illegal.

I won''t get into specifics, but the gist of the website can be explained in this example.

If you spend 200 dollars at a slot machine knowing that before you leave the casino you will be completely refunded the 200 dollars would that be considered gambling?

My website has a system where people will spend money to try and win products, but even if they don't win they still keep there money. The catch is that they can only spend that money to buy products from my website. In order to profit, i would mark-up products considerably, but that would not turn off buyers because the main selling point of the site is winning products

You may have a good plan here. It does not sound like gambling to me based on what you have said here...but it's not risk-free. This is worth hiring an attorney to actually review. Most of my gaming experience is with IGRA (Native Casinos) but I know that the refund angle is imperfect. There are disclosures to make but the plan seems eminently workable.
