Legal Question in Business Law in New York

Loud nightclub

I live in Jackson Height, Queens, NY, in

a fairly residential area (2 residential

buildings, houses etc).

2 nightclubs opened up recently,

causing an endless string of problems:

loud, drunk people, fights almost every

night, taxis honking their horn, etc

I've contacted the police several times

but they seem unable (or unwilling) to

do much.

Is there a law that could restrict the

opening of such establishements in a

residential area?

Zoning laws govern where night clubs may or may not be situated, and there are likely other local laws governing noise.

The police typically refrain from getting involved in disputes when they see it as generally a civil law matter.

The loud neighbor is a classic nuisance case. You may wish to consult an attorney about filing a civil lawsuit and seeking some sort of injunctive relief. Your case will be strengthened if they are violating existing laws.

There are specific zoning laws which prohibit where such clubs can be opened up, there are further laws restricting the amount of sound which these places are permitted to make.
