Legal Question in Business Law in New York

I signed a non-disclosure with my previous employer 16 years ago. During the 16 years, I've held several different positions. I left them 5 months ago because of a better employment option. I left in good terms with no exit interview or any meeting with HR. It was not until after I left was I provided the contents of my employee folder. During the past 5 months, they are threatening my current employer and me of breaking the contract due to the nature of my current business being similar.

The previous employer has some major ethical issues that can be exposed. Aside from the council my employer is getting for the company, should I seek a lawyer for myself?

I suggest you demand that your company's attorney represent you as well in the matter. If they agree, sign a retainer agreement first and ONLY THEN divulge information that may be helpful to your present employer to fight your previous employer. Otherwise, you have two choices. Retain your own attorney and divulge confidential information to him that may be helpful as a WHISTLE BLOWER situation as bargaining chip against your previous employer. Or leave your present employer and think of another job.

If you have real concerns then it might make sense to have the agreement reviewed and get some solid advice on your situation.

You can start by calling around to several for a free phone consultation, get some insights then pick the best fit to work with.

If you would like to discuss further over a free phone consult, feel free to contact me anytime that is convenient.

Our firm is now referred by the American Bar Association (see under the New York section):
