This depends in part on what municipal or county entity you are trying to sue. If it's a municipality, you must file a Notice of Claim within 90 days complying with NYS Gen. Municipal Law 50-e. If it's a county, the Notice of Claim must comply with NYS County Law 52. If it's the City of New York, in addition to Gen. Municipal Law 50-e, your Notice of Claim must comply with NYC Admin. Code 7-201. Other municipalities have often have their own notice of claim statutes, and a claim against the State of New York is subject to separate requirements (see NYS Court of Claims Act Sec. 10 and CPLR Art. 78).
