be prosecuted without being

Yes. If the prosecutor has eye witnesses or even circumstantial evidence that suggests your son's involvement, the prosecutor can pursue the case. Whether they can prove their case beyond a reasonable doubt is entirely different, but criminal cases can be won entirely on circumstantial evidence if strong enough.
