Legal Question in Construction Law in New York

terminating a contract

How long is a ''reasonable amount of

time'' to allow a contractor to make

attempts to fix a problem before you

can say ''Enough'' and terminate the

contract? We have an HVAC

Contractor who continues to make

attempts to fix the system, but after

5 months of trying, I am fed up? He

wants to keep going, I don't. When

can I tell him he is done and demand

a refund?

Re: terminating a contract

Depending on your contract and its terms... NOW. You should see an attorney but it sounds like you have been patient and gave more than a chance. Be sure to consult with a lawyer however because I do not have the benefit of having your agreement in front of me.

Good Luck.
