Legal Question in Consumer Law in New York

I live in NY I had concrete work done by a NJ contractor. The concrete over the winter began sporing, The contractor promised to repair it. Now she refuses to answer calls. This was a 12000 job. should I sue her in NY or NJ and how do I do that...Thank you very much

A contractor has to be licensed in New York to perform work. Did you check your contractor's credentials, his insurance binder and experience? Chances are, no matter where you sue him, you are going to hold the bag. I doubt he will answer your formal complaint. You can sue in New York Supreme Court, for Civil Court and small claims court have no jurisdiction and you are in for a pretty hefty bill in legal costs and bills. Apporach NJ Better Business Bureau and find out if they can help you.
