Legal Question in Criminal Law in New York

Accessory to a crime

Hello I am writing a novel and need help. If one were hosting a Russian Roulette game and was in the room when a suicidal individual took their life (and helped them plan it) what would they be charged with according to law in the state of NY., city NY? Would you be charged with accessory to suicide or murder, or something else? What is your educated opinion on what the person would be charged with? thanks.

Re: Accessory to a crime

He would be charged with Manslaughter in the second degree a class C felony carrying up to 15 years. Man 2 as we call it is not as serious as assault 1 degree. If your protagonist provided the weapons and bullets he may face stronger or greater charges. If he paid money to the winner, he may face Man 1* or even Murder 2 charges.

Below is the Man 2 statute.

S 125.15 Manslaughter in the second degree.

A person is guilty of manslaughter in the second degree when:

1. He recklessly causes the death of another person; or

2. He commits upon a female an abortional act which causes her death,

unless such abortional act is justifiable pursuant to subdivision three

of section 125.05; or

3. He intentionally causes or aids another person to commit suicide.

Manslaughter in the second degree is a class C felony.
