Legal Question in Criminal Law in New York

Self Defense

My brother is a Buffalo, N.Y. cab driver and at 4:15 one morning a man attempted to drag him out the cab and started to kick him, my brother in fear of his life stabbed him in the leg to break his grip then sped off. The man admitted to aggressively approaching the cab twice (not to assaulting him of course) now my brother is being charged with a B felony assault what can be done is there any similar cases that can be mentioned that will help, any motions for dismissal for self defense?

A B felony assault is very serious and can lead to decades in jail.

Self-defense is an appropriate defense. Were there any witnesses? What about your dispatcher? Did you have any documented bruises?

Tell your brother to get a good criminal defense lawyer. Self-Defense is an affirmative defense and requires the person putting forth the defense to prove it.

There is no magic bullet, there is only good representation.
