Legal Question in Criminal Law in New York

I was recently fired from a home based job from a company in Wisconsin, I live in New York and they provided me with a computer a phone and printer. I am collecting unemployment benefits now but they did try to contest it with the D.O.L in which I won by providing proof. So I think they were upset about it anyhow they have asked for their equipment back in which I have repeatedly told them it is ready for them to have a scheduled pick up from FedEx .they mailed me a label but they want me to bring the equipment to a FedEx office. I have told them I don't have a car to go drop it off and I care for my 4 year old son at home to do this. They have made threats to me saying they will file felony theft charges in equipment totaling $2500.00. (Which does not remotely come close to that cost) with the sheriff�s department. They refuse to have FedEx pick it up and they have had a marshal call my phone leaving a message stating for me to call him back. What are my rights here? I feel bullied and intimidated by their actions. Can they file felony theft charges? I have never stolen anything in my life. The solution is so simple but they don't want to schedule a pick up. Please help thank you for any advice

Well, this is their equipment, however, they could work with you to return it. You need to possibly speak with a civil attorney, rather than criminal, and perhaps they can negotiate some way that is mutually acceptable for you to get this equipment back to them. They can file theft charges, but they wouldn't get too far since you have tried to cooperate. Speak with a civil attorney to see if there is something in your contract as to how this material may be returned. If they do charge you with anything, contact a criminal defense attorney immediately.
