Legal Question in Criminal Law in New York

My super locked the roof to my building in NYC. The roof is padlocked with a standard over-the-counter lock.

I would really like to go on the roof just one night. He refuses to remove the lock.

If I tell him I am going to cut the lock and will compensate him for a replacement in advance or even buy an immediate replacement for him to put on once I leave the roof, could I face any legal charges?

Don't do it is my recommendation. There could be legal issues, and why upset the apple cart, esp for one night? It sounds like you want to do something nice up there, maybe propose, have friends over, but this just is not feasible. Your LL did the locking up for liability reasons, such as the lip not being high enough to offer even basic safety (and they know some people sit up there anyway) and the insurance may not even cover the LL if the LL allows something like this and the person gets hurt/killed. Maybe the LL even has something up there to hide, such as roof and/or equipment problems, maybe growing some "stuff" up there, so I can't see him/her/it allowing anyone up there for any reason.
