Dwi limit

If i came in at a .08 bac, can i fight the dui charge? I have never previously been stopped for this and i am over 21.

You can always fight the charge. However, you can be convicted for having a .08 BAC. You may have defenses available to you depending on the specific facts of your case and should consult with a criminal defense attorney.

You can absolutely fight this charge and you would be crazy not to try. There are many really fine lawyers in your neck of the woods. Seek out a lawyer who is a member of the State Bar Criminal Justice section AND a member of the NYS Association of Criminal Defense Lawyers.
