Legal Question in Entertainment Law in New York

Name of my Band

Hello,

My band, since 1998 has been called ''Space and Time''.

Recently, I have found out that there is a group called

''Spacetime Continuum'' that is very popular the electronic music world, performing at dance clubs and so on.

My band is a jazz group which performs around the globe.

Is there any conflict in our names legally, as far as similarity?

This is really a trademark question. Should only be a problem if there has been actual confusion of the two names. Be advised, though, that trademark is a very complicated area of the law. Please do not make any business or career decisions with re: your band name without conferring personally with an attorney.

From your description alone, there doesn't seem to be a problem. That is, there is no evidence of actual confusion between the two bands, and the names are significantly different. If you do want more protection for your name you could apply for a trademark registration.
