child custody case in nj

I have been raising my step nieces daughter full time for the last 15 months and prior to that four days a week since she was born in 2004. Her mother is a drug addict is hiv, bi polar and has hepatitis c. The mother is now in a rehab and is fighting me in court for custody. The judge stated that if she completes the program that she is entitled to her child. My question is, if she is bipolar and on methadone can she take care of a child on her own.

Your question is one that must be answered by a mental health professional and by the courts after a hearing. You should have an attorney and be prepared to go to trial on this if you truly feel that the mother is unfit.
