Legal Question in Family Law in New York

I'm getting a divorce, we will have joint custody of our child but I will have primary custody. If the father of the child refuses to pay child support, will I be able to move to another state or can the father contest to it even tho he doesn't pay child support? Are his rights affected if he doesn't pay child support?

Usually child support payments and custody don't go hand in hand. It certainly can be taken into consideration, but you really need to discuss this with your attorney before finalizing the divorce.
