Legal Question in Family Law in New York

Hello,

I would like to know if a husband and wife who were married in NY but reside in Delaware can file for a divorce in the state of NY. The wife has filed in Delaware but is having difficulty getting it accepted by the courts there. She and her husband own a home in Delaware in which she and her kids reside but the husband moved back to NY. Thank you.

If the marriage was in New York and the husband is a New York resident and has been for at least a year, yes, New York is a proper jurisdiction.

Has either spouse resided in New York for at least one year? If so this should be sufficient to file for a divorce in New York.
