Legal Question in Family Law in New York

What should I consider prior to remarriage?

What do I need to be aware of if I marry a man who pays maintenance and child support (one child) from a previous marriage. We both have professional careers and we make about the same amount of income. He currently has more assets and is 15 years older than I. But over the next 5-10 years, I suspect that my income will surpass his.

Re: What should I consider prior to remarriage?

You're already aware of his child support and alimony obligations, and, presumably of the term over which he'll have to meet those obligations. And you've apparently projected his income over the relevant period, to see if he'll be able to meet those obligations. Presumably you've decided the answer is that he will be able to do so.

If you have substantial assets that you're bringing into the marriage, you may want to protect yourself through a pre-nuptial agreement. However, prenups aren't exactly romantic - they can be interpreted to say to a partner that you're not sure this marriage is going to work out.

So - the real question before you may be how sure you are about your impending marriage.
