Legal Question in Family Law in New York

Hello,

I'm getting ready to file for divorce from my husband. I live and reside in NY. I I'm an American citizen. He lives and resides in Edmonton Canada. He's a Canadian citizen. We were legally married in Canada. He is refusing to give me his actual address. I have his parents address. They live in Vancouver Canada. I'm concerned that If I send them to the only address that I have (his parents). He will not sign and send then back. So would I file a 'Missing Spouse divorce'? If he's refusing to give me an address to serve him?

You need to speak to local counsel regarding this. You may be able to ask the Court for alternative service. You may also be able to file a divorce with service by publication. Either way, you cannot go it alone and will need an attorney to help you with this.

You must show efforts to locate. Use a PI to find him. No such thing as a "Missing Spouse Divorce".
