Legal Question in Family Law in New York

I am the uncle and godparent of my sister's child my sisters boyfriends mother whom is terminally ill with cancer also is physically disabled is trying to take custody of the infant knowing that my sister is able bodied to care for the child what legal leg does the fathers mother have to stand on ?

Please use sentences and punctuate-it makes it easier for others to understand. From what I can understand from what you wrote, little to nothing. The Family Courts tend to understand no parent is perfect but, under the right circumstances, in the BIC (Best Interests of the Child), children need at least some time with their parents. The variations of that "time" are customized for the BIC by the courts, if it gets there at all, so no one answer fits all.
