Legal Question in Medical Leave in New York

family medical leave act

2 questions...1st- i need to take the FMLA..am i required to provide proof of my fathers condition ? He would rather not have any strangers know.

2nd...I have accumulated vacation and sick time - am i allowed to use this time while on FMLA

This answer assumes you are a private employee.

(1) You don't have to disclose your father's condition. Your employee should provide you with forms for your father's doctor to complete. Also, you can obtain those forms from the Department of Labor's website (FMLA). Your father's doctor does not have to disclose his condition.

(2) You can request that you use vacation time while on FMLA. For more information, look in your employer's handbook and the Department of Labor's website (FMLA)
