Legal Question in Civil Litigation in New York

I hope this email will be answered in the Interest Of Justice. I called the cops on some people for making noise and harassing me. They decided to stalk me even across state lines. Everywhere they stalked me they also made sure to leave slanderous rumors around. When I got ill and in a nursing home they followed me here, and they have paid other patients to harass me by spraying insecticide, paint thinner and other toxic chemcials. Although I apprised administrator nothing was done to prevent this. When I complained about health care negligence I was retaliated by some of the staff. They have either facilitated the chemical assaults, participated themselves, or deprived me of sleep.

Obviouly this falls under nursing home abuse, but I'm not sure how to get things started. I intend to file an order to show cause to restrain them from further attacks, and other illegal actions, but I also want to sue for the damages. I want to be compensated for the monies I lost as result of their actions, and for punitive damages as well as for pain & suffering and emotional distress. The permanent effects on my vital organs of the toxic chemcials is also another factor. And lastly, I want the workers terminated and never to be allowed to work around patients.

Question: Can I incorporate a tort or other action with the OTSC and if so what do I need to do.

I need this answer by the 25th because it will take me a while to get back online.

My guess is that you have no proof that the incidents you complain about have any real connection to the persons about whom you called the police to complain about noise.

The facts, as you have stated them, sound a bit far-fetched. If you have any family members, I think it would be a good idea for you to talk with them about your suspicions and about what can be done to offer you proper reassurance that you are in a safe environment and one in which administrators and staff are looking out for your best interests.

I have noticed that quite often nursing home staff are more responsive to patients when family members or friends are involved on behalf of the patient. So, if you have family members who can intervene, that would be great. Or if you have other friends who can interact with nursing home staff and administrators, that would be good too.
