Legal Question in Civil Litigation in New York

Order of protection, harrassment

I have a harrassment, order of protection on my boyfriend and we were arguing (screaming) on the phone and 911 was called from my house because it is programed in my phone and I hit the wrong button to hang it up. The cops told me because of this I have to sign charges against him if not they will and I won't have any say to what happened. I don't want charges on my boyfriend it was just an arguement. Can they do this or do they have to have my permission? If so,why?

Re: Order of protection, harrassment

I have never heard of the police requiring someone to file harassment charges, when they didn't want to file them. The fact of an inadvertent 911 call is no basis for a harassment charge. I would stand my ground if I were you. If the police file harassment charges, without your supporting deposition, the charges will be dismissed, since you are the only witness.
