Legal Question in Civil Litigation in New York

I was staying with a friend for 3 months. On xmas day, there was a house fire (no one was in the house - dog & cat perished). Many of my belongings are in the house -incl. passport, portable hard drive, important, family papers, tax papers, all of my work papers. I am out of work and have been looking for work. Items that I need are in the house. The "friend" sent me a waiver that her son-in-law conjered up (he's a lawyer) that releases my friend, their insurance co., their bank, and anyone or anything from liability. Of course, I did not sign this because I don't even know what condition my things are in. They have basically said, in writing, that they will not give me back my things. Besides getting a lawyer, isn't there an office or isn't this Criminal? They have written that they have my things and they will not return them. It's already a month and a half. They have stopped comunicating with me and, for all I know, they have destroyed my things. Please tell me what to do. I do not want to sign a waiver that is so ridiculous. I am not looking for money. I need my things. I never asked for money or damages and did not intend to, however, I also am not stupid and theri disrespect for me is appalling. Help. What should I do?

You are in a bind. I do not understand why they will not furnish your stuff if they have it. You should apprise them of your intention to retain an attorney if they do not respond immediately, and retain one for real if they do not cooperate. You had better move fast; too much time has been wasted already, especially if insurance company is in play.
